Restraining Orders and Orders for Protection

Minnesota offers protection for victims of abuse or harassment in the form of restraining orders and orders of protection.

An order of protection can be sought if you or your children have been the victim of domestic abuse by someone within whom you are in a relationship of some sort. It requires an abuser to stop the abuse or face serious legal consequences. An order of protection can also:

  • Order the abuser to leave the house or apartment you share
  • Prohibit the abuser from coming to your place of work or where you live
  • Give you temporary custody of your children
  • Establish temporary financial support and use or possession of shared property
  • Prohibit the abuser from contacting you, even through a third party
  • Provide for counseling or treatment
  • Other relief as deemed necessary to protect you and your children

An order of protection is generally valid for up to two years, but a judge can decide to extend the timeframe if they find it necessary.

If you are not eligible to get an order for protection, you may be able to file a harassment restraining order.

A harassment restraining order is an order issued against a person who is harassing you, regardless of your relationship with that person. Harassment is when a person acts in such a way that they know will cause you fear, oppression, persecution, intimidation or threat and you actually feel threatened.

There are also other circumstances where you may seek a harassment restraining order, such as when you have been sexually assaulted or someone is stalking you or repeatedly contacting you against your will.

A harassment restraining order prevents your harasser from contacting you at all. If the harasser violates the order, they could go to jail.

A restraining order will generally be valid for up to two years.
